Privacy Policy
Effective date: September 15, 2026
Next Gen HR Solutions (“Next Gen HR,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our websites, apply for work, communicate with us, receive staffing or workforce services, interact with an assigned worksite, or participate in our text-messaging programs.
1. Scope
This Policy applies to personal information collected through Next Gen HR websites, online forms, job applications, employee and applicant communications, workforce-management tools, QR-code check-ins, surveys, and related services. A client worksite, payroll platform, benefits provider, or other third party may maintain its own privacy policy for information it collects directly.
2. Information We Collect
Depending on your relationship with us, we may collect:
- Identifiers and contact details, such as your name, mailing address, email address, telephone number, date of birth, and government-issued identifiers where legally permitted or required.
- Applicant and employment information, such as employment history, skills, qualifications, availability, work authorization, assignment details, start and end dates, shift, attendance-related information, payroll and tax information, and screening results.
- Communications and preferences, including messages sent to or from us, survey responses, language preference, requests for assistance, and communication choices.
- Text-messaging information, including your mobile number, opt-in and opt-out status, the date, time, source, and wording of consent, message content, delivery status, and HELP or STOP requests.
- Check-in and workforce-interaction information, such as the location or client site associated with a QR code, check-in date and time, selected shift, verified-device status, and exceptions submitted for review. A QR check-in is an operational workforce record and is not official payroll timekeeping unless Next Gen HR expressly states otherwise.
- Website and device information, such as IP address, browser and device type, pages viewed, referring pages, cookies, and similar technical data.
- Other information you choose to provide or that we are permitted or required to collect to provide staffing, payroll, screening, recruiting, or workforce-management services.
3. Sources of Information
We may collect information directly from you; from recruiters, account managers, or authorized representatives; from clients and assigned worksites; from references, screening providers, payroll or workforce platforms; from publicly available sources; and automatically when you use our websites or digital services.
4. How We Use Information
We may use personal information to:
- Recruit, evaluate, place, onboard, support, and communicate with applicants and workers.
- Administer assignments, scheduling, shift check-ins, attendance support, payroll, benefits, safety, compliance, and workforce services.
- Send requested or consented communications, including onboarding information, assignment updates, reminders, weekly job-feedback surveys, assistance responses, and other employment-related messages.
- Confirm identity, maintain accurate records, prevent fraud or misuse, and protect workers, clients, and our services.
- Operate, maintain, analyze, and improve our websites, services, communications, and workforce programs.
- Comply with applicable laws, legal process, contractual obligations, audits, and recordkeeping requirements.
5. SMS Privacy and Mobile Information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
We do not sell or share mobile telephone numbers, SMS opt-in data, or SMS consent with third parties or affiliates for their marketing or promotional purposes. The information-sharing categories described elsewhere in this Policy exclude text-messaging originator opt-in data and consent. We may provide mobile information to service providers that help us operate the messaging program, such as telecommunications, messaging, hosting, and support providers, but only as necessary for them to perform services for us and not for their own marketing or promotional purposes.
Participation in a recurring text-messaging program is voluntary and is not a condition of applying for or accepting employment. For weekly workforce feedback, message frequency is up to one survey per week, plus messages related to your application, assignment, or feedback. Message and data rates may apply. You may reply STOP to opt out or HELP for help. After a STOP request, you may receive one final confirmation message. Opting out of SMS does not change your employment or assignment status, and we may contact you through another lawful channel when necessary. Additional terms appear in our SMS Terms & Conditions.
6. How We Disclose Information
We may disclose personal information, other than mobile opt-in data and consent as restricted above:
- To clients and assigned worksites when reasonably necessary to evaluate placement, administer an assignment, support safety or attendance, or provide contracted workforce services.
- To service providers that perform recruiting, screening, payroll, benefits, technology, hosting, security, analytics, communications, document, or professional services for us.
- For legal and safety purposes when required by law or when reasonably necessary to protect rights, safety, property, workers, clients, or the public.
- In a business transaction involving a merger, financing, acquisition, reorganization, or transfer of all or part of our business, subject to applicable law.
- At your direction or with your consent.
7. Cookies and Similar Technologies
Our websites may use cookies and similar technologies to remember preferences, understand website use, maintain security, and improve performance. You can adjust browser settings to limit cookies, although some site features may not function properly.
8. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including staffing and employment administration, legal and contractual obligations, dispute resolution, safety, audits, and enforcement of agreements. Retention periods vary by the type of record and applicable law.
9. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No security measure or method of transmission is completely secure, and we cannot guarantee absolute security.
10. Your Choices and Privacy Rights
You may update communication preferences, request correction of certain information, or ask questions about our privacy practices by contacting us. Depending on where you live and your relationship with us, applicable law may provide additional rights to access, correct, delete, or obtain a copy of certain personal information, or to appeal a response. We may need to verify your identity and may retain information when permitted or required by law.
To stop recurring text messages, reply STOP. For assistance, reply HELP or use the contact information below.
11. Children’s Privacy
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 through our websites or messaging programs.
12. External Links
Our websites and messages may link to third-party websites or services. Their privacy practices are governed by their own policies, not this Policy.
